TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using Dwely ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms apply to all users of Dwely, including free and paid subscribers.

2. DESCRIPTION OF SERVICE

Dwely is a home management application that allows users to track household assets, warranties, maintenance tasks, service contacts, and service records. The App is available on Android devices and is operated by Dwely ("we," "us," or "our").

3. ACCOUNTS AND REGISTRATION

You must create an account to use Dwely. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering. You must be at least 13 years of age to use the App.

4. SUBSCRIPTIONS AND PAYMENTS

Free Plan: Dwely offers a free plan with the following limits: up to 5 entries (assets, tasks, and contacts combined), up to 2 household members, and up to 5 photos.

Dwely Pro: Premium features are available via a paid subscription ("Dwely Pro"):

- Monthly plan: $2.99 per month

- Annual plan: $23.88 per year ($1.99/month equivalent)

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time through the App (Settings → Subscription). Cancellation takes effect at the end of the current billing period. You will retain Pro access until the period ends. No refunds are issued for partial billing periods.

Price Changes: We reserve the right to change subscription prices with 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.

5. HOUSEHOLD MEMBERS

You may invite other users to your household. Invited members can view your household data but cannot modify it. You are responsible for all activity by members you invite. You may remove members at any time.

6. USER CONTENT

You retain ownership of all content you upload to Dwely (photos, documents, notes). By uploading content, you grant us a limited licence to store and display it solely to provide the Service. We do not share your content with third parties except as described in our Privacy Policy.

7. PROHIBITED USES

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorised access to our systems; (c) upload malicious content; (d) use the App to harass others; (e) reverse-engineer or decompile the App.

8. INTELLECTUAL PROPERTY

The App, including its design, code, and branding, is owned by Dwely and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

9. DISCLAIMERS

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED. DWELY IS A TOOL TO HELP YOU ORGANISE HOME INFORMATION — WE ARE NOT RESPONSIBLE FOR MISSED MAINTENANCE, EXPIRED WARRANTIES, OR ANY LOSSES ARISING FROM YOUR USE OF THE APP.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DWELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. TERMINATION

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time in Settings → Delete Account. Upon deletion, all your data is permanently removed.

12. CHANGES TO TERMS

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use after changes take effect constitutes acceptance.

13. GOVERNING LAW

These Terms are governed by the laws of the jurisdiction in which Dwely operates, without regard to conflict of law principles.
